WASHINGTON – The Supreme Court issued a one-sentence statement Tuesday confirming the eight-person court is divided on the Rebecca Friedrichs case contesting mandatory teacher union dues.
The statement: "The judgment is affirmed by an equally divided Court."
Had Antonia Scalia lived and issued an opinion on the Friedrich case, the Court would likely have decided 5 to 4 to overrule a lower court decision. Now the lower federal court ruling stands in favor of the California Teachers Union.
The dispute involved the rights of public-sector unions to charge non-members fees to cover the cost of collective bargaining — something they will now continue to be able to do in states that permit it.
